Overview and Acceptance

These Terms of Service (“Terms”) govern your access to and use of casepoppy.com, our online store, and the products and services offered through it (collectively, the “Services”). The Case Poppy store is operated by Silver Grove Commerce Inc. In these Terms, “Case Poppy,” “we,” “us,” and “our” refer to Silver Grove Commerce Inc.

By accessing or using the Services, or by placing an order, you agree to these Terms and to the policies linked in them. If you do not agree, do not use the Services. Any new feature or tool added to the store is also subject to these Terms.

Eligibility and Lawful Use

You must be old enough to form a binding contract where you live, or use the Services with the involvement and consent of a parent or legal guardian. You may use the Services only for lawful personal or business purposes and in compliance with applicable law.

You must not use the Services to violate another person’s rights, introduce malicious code, interfere with the store or its security, collect information without authorization, submit false information, or engage in fraud or unlawful conduct.

Accounts and Information You Provide

You are responsible for providing current, complete, and accurate account, billing, shipping, and order information. You are also responsible for maintaining the confidentiality of any account credentials and for activity that occurs through your account.

Products, Compatibility, and Display

We make reasonable efforts to describe and display products accurately. Product details, compatibility, colors, dimensions, materials, print coverage, availability, and pricing are subject to the information shown on the relevant product page when you order.

You are responsible for selecting the correct phone model and reviewing every product option before purchase. Cases made for different models or generations may look similar but are not interchangeable.

Colors and placement may vary slightly between an on-screen image and a finished product because displays, materials, print processes, and phone models differ. Minor differences within normal production tolerances are not defects. A phone or other device is not included unless expressly stated.

Orders and Acceptance

Your order is an offer to purchase the products shown at checkout. An order confirmation acknowledges receipt of the order but does not guarantee acceptance or fulfillment. We may accept, reject, limit, or cancel an order for reasons including product unavailability, suspected fraud, inaccurate information, a pricing or listing error, a legal restriction, or an item we cannot produce as requested.

If we cancel an item after payment has been authorized or captured, we will release the authorization or refund the amount paid for that item to the original payment method. We may limit quantities purchased per person, household, account, payment method, billing or shipping address, or order.

Prices, Taxes, and Payment

Prices may change before an order is placed. The price, available discounts, shipping charges, taxes, and total shown at checkout apply to the order, subject to correction of obvious errors as permitted by law.

You authorize the selected payment provider to charge the payment method supplied at checkout. Payment processing is provided by third parties and may be subject to their terms. You represent that you are authorized to use the payment method submitted with the order.

Personalized Orders

Before placing a personalized order, review the phone model, uploaded file, image orientation, spelling, and print-layout choice carefully. Any on-screen thumbnail or layout guide is a selection aid and is not a color-accurate printed proof.

You must own or have permission to use any image, artwork, logo, text, or other material you submit. You must not submit material that is unlawful, infringes another person’s intellectual-property, privacy, publicity, or other rights, or cannot lawfully be reproduced.

Personalized and custom products are final sale for non-quality reasons. This does not affect support for an item that arrives damaged, has an eligible manufacturing defect, or was produced incorrectly by Case Poppy. See our Returns & Refunds Policy.

Order Changes and Cancellations

Email info@casepoppy.com as soon as possible if you need to request a change or cancellation. We will do our best to help, but an order cannot be changed or canceled after it enters production or ships. Personalized orders may enter production shortly after purchase, so changes are not guaranteed.

Shipping, Returns, and Warranty

Processing, production, delivery estimates, tracking, address changes, and shipping support are described in our Shipping & Delivery Policy.

Return eligibility, personalized-product exclusions, refunds, and exchanges are described in our Returns & Refunds Policy.

Any separate written limited warranty applies in addition to rights that cannot lawfully be excluded. No phone case can prevent every type of damage, and Case Poppy does not guarantee that a phone or other device will remain undamaged in every drop, impact, or exposure.

Store Content and Intellectual Property

The Services and their content—including the Case Poppy name, logos, original designs, artwork, graphics, photographs, text, layouts, software, and product templates—are owned by Silver Grove Commerce Inc or used with permission, unless otherwise stated.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for their intended purpose. You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, scrape, or commercially exploit the Services or their content except with written permission from the applicable rights holder or as permitted by law.

Third-Party Services and Links

The store is powered and hosted by Shopify. We may also use third-party services for functions such as payment processing, fulfillment, shipping, analytics, or customer support. Your use of a third-party service may be governed by that provider’s terms and privacy notice.

Links to third-party websites are provided for convenience. We do not control and are not responsible for third-party content, availability, products, services, privacy, or security. Review the applicable third-party terms before using those services.

Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. Shopify also processes information in connection with the Services as described there.

Errors, Availability, and Changes to the Services

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions. We may correct information, update content, change or discontinue products or features, or cancel affected orders, subject to applicable law.

We do not promise that every product, feature, or part of the Services will remain available at all times. We may suspend access when reasonably necessary for maintenance, security, legal compliance, or protection of the Services and their users.

Disclaimers and Consumer Rights

To the fullest extent permitted by law, the website and online features are provided on an “as available” basis. We do not warrant that access will always be uninterrupted, timely, secure, or error-free.

This disclaimer does not replace any express product warranty and does not exclude, restrict, or modify any guarantee, warranty, remedy, or other consumer right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Case Poppy and its directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.

Suspension and Termination

We may restrict or terminate access to the Services if we reasonably believe a user has violated these Terms, created a security or legal risk, or engaged in fraud or abuse. Obligations and liabilities incurred before termination, and provisions that by their nature should survive, remain effective.

Changes to These Terms

We may update these Terms to reflect changes to the Services, our operations, or legal requirements. The revised Terms will be posted on this page with an updated effective date. Changes apply prospectively unless applicable law requires otherwise.

Severability, No Waiver, and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of that provision. These Terms and the policies expressly incorporated by reference form the entire agreement concerning your use of the Services, except for any additional terms presented and accepted for a specific product or feature.

Applicable Law

These Terms are governed by the laws that apply to Silver Grove Commerce Inc and the transaction, without limiting any mandatory consumer protections that apply where you live. Nothing in these Terms requires a consumer to give up a right or remedy that cannot lawfully be waived.
